What Is Considered Theft in Texas?
Texas law defines theft as the unlawful taking of property from another person. A person commits theft if he or she intentionally or knowingly obtains or exerts control over property without the owner's consent.
Theft can be committed in a variety of ways, including:
- Stealing something with the intent to permanently deprive the owner of the property
- Obtaining control over property by deception
- Obtaining control over property by threat, force, or intimidation
- Enters a building without permission in order to steal something
- Stealing property while it is being shipped
- Stealing a firearm or vehicle
If a person commits theft of property worth more than $100,000, they can be charged with a first-degree felony. A person who commits theft of property worth more than $1 million can be charged with a first-degree felony under the Texas Organized Crime Act.
Penalties for Theft in Texas
A person who is convicted of theft can be sentenced to jail time, probation, community service, and/or restitution. The penalties for theft will depend on the value of the property that was stolen. A person who is convicted of misdemeanor theft may be sentenced to up to 180 days in jail and/or a fine of up to $2,000. A person who is convicted of felony theft may be sentenced to up to two years in prison and/or a fine of up to $10,000.
