What Is Alimony?

Alimony, also known as spousal support or maintenance, is a court-ordered financial obligation that one spouse has to pay to the other spouse after a divorce. This obligation may be temporary or permanent and is determined by the court based on the facts and circumstances of each case.

Types of Alimony

Temporary Alimony

Temporary alimony is paid by one spouse to the other for the purpose of allowing the recipient to maintain the marital standard of living until a final divorce decree is issued. Temporary alimony is generally awarded when the marriage lasted more than ten years and the recipient spouse is financially dependent on the other spouse.

Permanent Alimony

Permanent alimony is paid by one spouse to the other for the purpose of enabling the recipient to maintain the standard of living established during the marriage. Permanent alimony is generally awarded when the marriage lasted more than ten years and the recipient spouse is financially dependent on the other spouse.

Lump-Sum Alimony

Lump-sum alimony is a one-time payment of a specified amount of money. Lump-sum alimony is generally awarded when the marriage lasted less than ten years and the recipient spouse is financially dependent on the other spouse.

Rehabilitative Alimony

Rehabilitative alimony is paid by one spouse to the other for the purpose of enabling the recipient to obtain training, education, or skills so that the recipient can find employment. Rehabilitative alimony is generally awarded when the marriage lasted less than ten years and the recipient spouse is financially dependent on the other spouse.

How Is Alimony Determined in Texas?

The Texas Family Code provides guidelines for alimony. However, the judge has discretion in making a decision based on the facts and circumstances of each case. 

The court will consider a number of factors when deciding on alimony, including:

  • The standard of living established during the marriage
  • The financial situation of each spouse
  • The length of the marriage
  • The age and health of both spouses
  • The financial resources of both spouses
